SeleCalc Terms of Use
These SeleCalc Terms of Use form an agreement between the user (“you”) and Habasit AG (“Habasit”) and govern your use of the SeleCalc Application (the “SeleCalc Application”).
Please read these Terms of Use carefully before using the SeleCalc application, including Habasit’s disclaimers on the Product Data Sheets of the products you are interested in, Habasit’s Legal Disclaimer and Habasit’s Privacy Statement, which all are incorporated herein by reference in their latest version and form an integral part of the SeleCalc Terms of Use (together: “the SeleCalc Terms of Use”). By accessing the SeleCalc Application you agree to the SeleCalc Terms of Use. If you do not agree to the SeleCalc Terms of Use you must not use the SeleCalc Application.
1. Purpose of the SeleCalc Application
The SeleCalc Application is offered by Habasit free of charge and is intended to provide assistance in the evaluation of application cases, in the selection of fit of belt and in conveyor design.
The SeleCalc Application is for general information only. The results provided by the SeleCalc Application are not intended to constitute advice of Habasit on which you should rely. You are encouraged to obtain professional or specialist advice before taking, or refraining from, any action on the basis of any results of the SeleCalc Application.
2. Access to the SeleCalc Application
Access to the SeleCalc Application requires login credentials and a password. Where we have given you (or where you have chosen) login credentials and a password which enable you to access the SeleCalc Application, you are responsible for keeping the login credentials and the password confidential. We ask you not to share your login credentials and your password with anyone.
3. No Representations, Guarantees or Warranties
All information provided by the SeleCalc Application is provided with appropriate diligence and care, but no representations, guarantees or warranties of any kind, neither express nor implied, are made, including, but not limited to, representations, guarantees or warranties of performance, completeness, merchantability, accuracy, being up-to-date or suitability for a particular purpose.
Habasit does not represent, guarantee or warrant that the SeleCalc Application will meet your requirements or the operation of the SeleCalc Application will be uninterrupted or error-free.
You will be requested to enter certain parameters into SeleCalc Application. Such parameters as well as the final conditions of use are outside of Habasit’s knowledge and control. In consequence, Habasit cannot assume any liability whatsoever, in particular no liability concerning the suitability and process ability of the products for a particular purpose resulting from the use of the SeleCalc Application. You assume all responsibility for the selection of the SeleCalc Application to achieve your intended results and for the results obtained from it. Please contact an authorized Habasit sales specialist for further advice.
The data provided in the SeleCalc Application are based on laboratory application with small-scale test equipment, running at standard conditions, and do not necessarily match product performance in industrial use.
New knowledge or experience may lead to re-assessment and modifications within a short period of time and without prior notice.
4. Exclusion of Liability
Habasit excludes all liability for damages whatsoever (including, without limitation, cost of procurement of substitute goods, property damage, loss of profits, interruption of business, loss of data or for any other special, indirect, consequential or incidental damages) arising out of the use of or inability to use the SeleCalc Application, even if Habasit has been advised of the possibility of such damages. This exclusion of liability does not apply in case of damage caused by willful misconduct or gross negligence.
5. No Transfer of Intellectual Property Rights and No Grant of Licenses
You must not:
- systematically copy any part of the SeleCalc Application for commercial purposes (whether by printing it on paper, storing as a digital file or otherwise), in particular by the use of automated systems or software to extract data from the SeleCalc Application (‘screen scraping’);
- remove, modify or render unintelligible the contents, or use the material contained on the SeleCalc Application for any other purpose than provided for in these terms and conditions;
- use the SeleCalc Application or the information contained on it for illegal purposes;
- provide or make available to any third party or parties, with or without charge, documents or extracts from the SeleCalc Application for your own commercial purposes.
The contents of the SeleCalc Application may exclusively be printed or copied by other means for your internal use. You must not modify, copy, send, transmit, expose, present, reproduce, publish, license, use as a frame in another website, transfer or create derivative products from contents of the SeleCalc Application, nor use such contents in any other way for commercial or public purposes, subject to any statutory usage permissions to the contrary.
6. Entitlement of Habasit to Modify or Cease Offering the SeleCalc Application
Habasit may at any time, temporarily or permanently, with immediate effect and without providing reasons modify the SeleCalc Application or cease offering the SeleCalc Application to you or to all users.
7. Data Protection, Privacy and Information Security
The Privacy Statement which is published on this website is incorporated herein by reference and forms an integral part of these SeleCalc Terms of Use.
8. Applicable Law
These SeleCalc Terms of Use are governed by the substantive laws of Switzerland without regard to any conflict of laws rules.
9. Jurisdiction
Any dispute arising out of or in connection with these SeleCalc Terms of Use shall be submitted to the exclusive jurisdiction of the Zivilkreisgericht Basel-Landschaft West.
